1. About these terms

These terms apply to the PersonalizeWP software, licences, updates and support provided by Filter Digital Limited, company no. 10238317, Argent House, 5 Goldington Road, Bedford, MK40 3JY (“PersonalizeWP”, “we”, “us”). By purchasing, redeeming or using a licence, you agree to these terms.

2. Licences

We offer the following licence types:

  • Subscription licences: give access to updates and support for the subscription term you choose, renewing automatically unless cancelled.
  • Lifetime licences: give access to updates and support for the lifetime of the PersonalizeWP product, with no renewal fees.

Each licence covers the number of sites and features stated at the point of purchase or redemption.

3. Lifetime licences

“Lifetime” means the period during which we continue to develop and sell PersonalizeWP, not the lifetime of the licence holder. If we discontinue the product, we will give at least 90 days’ notice, after which updates and support will end. The software you have installed will continue to work under the GPL.

4. Promotional and free licences

From time to time we may offer licences free of charge or at a discount. Unless stated otherwise in the offer:

  • one promotional licence is available per company, as determined by us
  • offers must be redeemed by the stated date and are subject to availability
  • we may verify eligibility and decline any redemption at our discretion
  • we may amend, suspend or withdraw an offer at any time before redemption
  • we may revoke a licence obtained through misuse, fraud or breach of these terms
  • promotional licences are non-transferable, have no cash value and cannot be exchanged
  • discounts apply to the first term only

Our decision on all matters relating to an offer is final.

5. Support

We provide support for active licences, mainly by email at support@personalizewp.com. Support covers the use of PersonalizeWP features and does not include custom development or third party plugin and theme issues.

6. Installation

You can install PersonalizeWP automatically or manually. You are responsible for checking your site is compatible before installing. We cannot accept responsibility for issues arising from installation, including security issues or downtime.

7. Updates

We release updates to improve functionality and fix bugs. Updates are available while your licence is active. You can update manually or enable automatic updates. You are responsible for ensuring your site remains compatible with updates. All updates are owned by PersonalizeWP and released under the GPL.

8. Fees, payment and refunds

Subscription fees are payable in advance. Refunds are available within 14 days of payment in most cases; see our refund policy for details. Free promotional licences are not eligible for refunds. We may change subscription fees for future terms and will give notice before any change applies to you.

9. Suspension and termination

We may suspend or cancel a licence if:

  • the site(s) using it contain explicit, illegal or offensive content
  • you or your staff are abusive towards our team
  • you repeatedly make unreasonable demands outside the scope of these terms
  • you breach these terms

We will tell you in writing why we have taken this action. You can cancel a subscription at any time, effective at the end of the current billing period.

10. Confidentiality

We keep all non-public information you share with us confidential. This does not apply to feedback or suggestions for improvements.

11. Personal data

You must not share personal data with us except as described in our Privacy Policy. If you do, you are responsible for the costs of its processing and removal, including any regulatory fines.

12. Limitation of liability

Except for intentional misconduct or gross negligence, we are not liable for damages arising from use of the software or services, including data loss, downtime, lost revenue or lost profits. Nothing in these terms limits liability that cannot be limited by law.

13. Changes to these terms

We may update these terms. Changes to promotional offer terms apply immediately to unredeemed offers. For existing licence holders, we will give at least 30 days’ notice of material changes by email or on our website.

14. Governing law

These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

15. Software licence

PersonalizeWP is licensed under the GNU General Public License v3. Under Section 7 of the GPL, the following additional terms apply:

  • you must not misrepresent the origin of the software, and modified versions must be clearly marked as different from the original
  • you may not use the names of the licensors or authors for publicity purposes without permission
  • no rights are granted to use the trade names, trademarks or service marks of PersonalizeWP
  • anyone conveying the software with contractual assumptions of liability must indemnify the licensors and authors against any liability those assumptions impose
